We support the uncensored flow of information and ideas over the Internet and do
not routinely monitor activity of accounts except for measurement of
system utilisation and preparation of billing records. However, if we become aware of inappropriate use of our service, we respond appropriately.
Illegal Use
APC-Hosting's services may be used for lawful purposes only. Transmission,
storage, or distribution of any information, data or material in
violation of any applicable law or regulation is prohibited.
Unsolicited Commerce Email / Unsolicited Bulk Email (SPAM)
Spamming from or through an APC-Hosting
service, or using an email address that is maintained on an APC-Hosting server is STRICTLY prohibited. You may not use, or permit
others to use, our network to transact SPAM. A violation
of this policy will result in an "Administrative Fee"
of $500.00 being charged to the client's authorised credit card, and the account will be terminated immediately.
Adult Content
APC-Hosting does allow legal adult content. APC-Hosting considers an adult as someone over the age of 18, and a minor as a person below the age of 18.
Harm to Minors
Use of the APC-Hosting service to harm, or attempt to harm, minors
in any way, including, but not limited to child
pornography is STRICTLY prohibited. Any account found to host child pornography or linking to the same will be terminated immediately. Any implication of under-age content or misleading information perceived
to be child pornography will result in the same penalties. All violations will be
reported to appropriate authorities.
Copyright, Patent, Trademark, Trade Secret, and Intellectual Property
Use of the APC-Hosting service to transmit
or publish any material (via email, uploading, posting, hot linking, directly linking or otherwise)
that infringes any copyright, trademark, patent, trade secret or other proprietary
rights of any third party, without proper
authorisation is prohibited.
Defamation and Threats
Freedom of speech ceases to be a freedom when it crosses the line to become an illegal incitement. Distribution and/or publishing of material that is defamatory, incites hatred or
constitutes an illegal threat is prohibited. All violations will be
reported to appropriate authorities.
Distribution of Viruses
Intentional distribution of software that attempts
to and/or causes damage, harassment, or annoyance to persons, data, and/or computer
systems are prohibited. Such an offense will result in the immediate termination
of the offending account.
Hackers and Spammers
Websites or services
that support spammers or hackers and their exploits in any way are prohibited.
Unauthorised access
Accessing, or to attempt
to access, the accounts of others, or to penetrate, or attempt to penetrate, security
measures of APC-Hosting's or another entity's computer software or hardware, electronic
communications system, or telecommunications system, whether or not the intrusion
results in the corruption or loss of data, is strictly prohibited.
Fraudulent activity
Misrepresentation or misleading statements, content
or activity made with the intent that the person receiving it will act upon it, is considered fraud. Making fraudulent offers
to sell or buy products, items, or services, or to advance any type of financial
scam such as "pyramid schemes", "Ponzi schemes", and "chain letters" is prohibited.
Peer to Peer Software (File Sharing)
The use of Peer to Peer or file sharing
software to permit the sharing, copying or distribution of unauthorised copyrighted
material is prohibited.
IRC
APC-Hosting does not allow IRC or IRC bots to be operated on its servers. Accounts connecting
to or part of these networks will be suspended immediately.
Security
Any attempt to undermine or cause harm to an APC-Hosting server or client
is strictly prohibited. Users who violate systems or network security may incur criminal or civil liability.
- You may not use your account to breach security of another account
or attempt to gain unauthorised access to another network or server.
- You may not attempt to circumvent user authentication or security of any host, network
or account. This includes, but is not limited to, accessing data not intended for
you, logging into or making use of a server or account you are not expressly authorised
to access, or probing the security of other networks. Use or distribution of tools
designed for compromising security is prohibited, including but not limited to, password guessing programs, cracking tools or network probing
tools.
- You may not attempt to interfere with service to any user, host or network ("denial
of service attacks"), including but not limited to, "flooding" of networks,
deliberate attempts to overload a service, and attempts to "crash" a host.
Network Resources
APC-Hosting accounts operate on shared resources. Excessive use or abuse of these
shared network resources by one customer may have a negative impact on all other
customers. Misuse of network resources in a manner which impairs network performance
is prohibited.
You may not use resource-intensive programs
which negatively impact other clients or the performance of APC-Hosting systems
or networks.
Accounts that use a high amount of server resources (such as,
but not limited to, CPU time, memory usage, and network resources)
will be given an option of either paying extra (which depends on
the resource needed) or reducing the resource used to an acceptable
level.
